1. Introduction

Welcome to SmartTrakr® — a brand operated by Pawfect Co UK Ltd (“we,” “us,” “our”).
By purchasing SmartTrakr® products, downloading our app, or using our website, you agree to these Terms of Service (“Terms”).
Please read them carefully. If you do not agree, you must not use our products or services.

To use the SmartTrakr® App or create an account, you must:

• Be 18 years or older (or have parental consent); and
   

• Provide accurate, current information.
   

You are responsible for keeping your login credentials secure and for all activity under your account.

 

4. Products and Services

SmartTrakr® provides QR-coded storage labels, digital inventory tools, and related software.
All items are described as accurately as possible; minor variations in packaging or design may occur.
We reserve the right to modify or discontinue any product at any time.

 

5. Pricing and Payment

All prices are listed in GBP (£) and include applicable UK VAT unless stated otherwise.
Payment is processed securely through approved third-party gateways (e.g. Etsy, Amazon, Stripe, PayPal).
Orders are confirmed once payment has been successfully received.

 

6. Shipping & Delivery

We ship from the UK to approved regions.
Estimated delivery times are provided for guidance only and may vary due to postal or customs delays.
Risk passes to the buyer once the item is delivered to the address provided at checkout.

 

7. Returns & Refunds

We gladly accept returns within 14 days of delivery in accordance with the Consumer Rights Act 2015.
Items must be unopened, unused, and in their original undamaged packaging.
Please contact us before returning any item so we can assist and provide the return address.
Refunds are issued once the returned items are received and inspected.
Buyers are responsible for return postage costs unless the item is defective or incorrect.

 

8. EU Right of Withdrawal

If you are located in the European Union, you have 14 days from receipt to withdraw from your purchase without giving a reason.
To exercise this right, contact us via Etsy Messages or email within 14 days.
Returned items must be unopened, unused, and in their original packaging.
We will issue a full refund (including standard shipping costs) within 14 days of receiving the item in acceptable condition.
Buyers are responsible for return postage costs.

 

9. Digital Products and App Usage

Use of the SmartTrakr® App is subject to these Terms and any app-store policies.
You must not copy, decompile, reverse-engineer, or modify the app software.
We may update or discontinue features without notice to improve performance or security.

 

10. Intellectual Property

All content — including logos, graphics, text, QR codes, and software — is the intellectual property of Pawfect Co UK Ltd and its licensors.
You may not reproduce or use any SmartTrakr® materials for commercial purposes without written permission.

 

11. User Data & Privacy

We collect and process personal data in accordance with our Privacy Policy.
By using the SmartTrakr® App or website, you consent to the collection and processing of your information as described therein.

 

12. Lifetime Access Policy

12.1 Definition
“Lifetime Access” refers to continued access to the SmartTrakr® App and related digital services for as long as Pawfect Co UK Ltd continues to operate and maintain the platform. It does not refer to the user’s lifetime and does not guarantee perpetual service.

12.2 Service Continuity
We aim to offer long-term support but may modify, suspend, or discontinue any feature at our discretion.

12.3 Company Dissolution or Discontinuation
If Pawfect Co UK Ltd ceases trading or dissolves, access to cloud-based data or app features may end. Where possible, reasonable notice will be given for users to export data.

12.4 Transfer or Sale of Business
If SmartTrakr® is sold or transferred, user data and access will be governed by the new owner’s terms. After such transfer, Pawfect Co UK Ltd has no further obligation to provide services.

12.5 Limitation of Liability
To the fullest extent permitted under UK law, Pawfect Co UK Ltd and its directors shall not be liable for loss or damage arising from service discontinuation, data loss, or company closure.
Products and services are provided “as is,” without guarantee of continuous operation.

12.6 Governing Law
This clause is governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.

 

13. Limitation of Liability (General)

Nothing in these Terms limits our liability for death or personal injury caused by negligence or for fraudulent misrepresentation.
Otherwise, Pawfect Co UK Ltd shall not be liable for any indirect, incidental, or consequential damages arising from use of our products or services.

 

14. Termination

We may suspend or terminate your access to the SmartTrakr® App if you breach these Terms or engage in unauthorised activity.
Upon termination, your right to use the service will immediately cease.

 

15. Amendments

We reserve the right to update these Terms at any time. Changes will be posted on our website and effective immediately upon publication. Continued use of our services after such changes constitutes acceptance of the revised Terms.

 

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
